Terms of Service

Welcome to ParkHawaii ("we," "us," or "our"). ParkHawaii is a peer-to-peer parking marketplace that connects people who have unused parking spaces ("Hosts") with people who need parking ("Renters") across the Hawaiian Islands.

By accessing or using ParkHawaii, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

ParkHawaii provides an online platform that enables Hosts to list parking spaces and Renters to discover, book, and pay for those spaces. We act as an intermediary and do not own, operate, or manage any parking spaces listed on the platform.

Hosts create listings that describe their parking spots, set pricing, and manage availability. Renters browse listings, select dates, and complete bookings through our secure checkout process. ParkHawaii facilitates the payment between Renters and Hosts.

As a Host, you are responsible for ensuring that your listing is accurate, up-to-date, and does not violate any local laws, HOA rules, or lease agreements. You must have the legal right to rent out the parking space you list.

Hosts must maintain their parking spaces in a safe and accessible condition. You are responsible for providing clear directions and any access instructions to Renters. Hosts must honor confirmed bookings and communicate promptly with Renters about any changes.

Hosts are responsible for reporting all income earned through ParkHawaii to the appropriate tax authorities. ParkHawaii may provide tax documentation as required by law.

As a Renter, you agree to use parking spaces only for lawful purposes and only during your confirmed booking period. You must follow any rules or instructions provided by the Host, including size restrictions and access procedures.

Renters are responsible for any damage caused to the parking space or surrounding property during the booking period. You must vacate the space by the end of your booking. Overstaying may result in additional charges.

Renters agree to park only the vehicle type appropriate for the space and to keep the area clean during use.

ParkHawaii processes all payments securely through Stripe. Renters pay the listed price at the time of booking with no additional service fees. What you see is what you pay.

Hosts receive their payout after the booking period begins, minus a platform commission. Payout timing depends on the Host’s configured payout method and may take 2–5 business days to process.

All prices are listed in US Dollars (USD). ParkHawaii reserves the right to adjust its commission structure with advance notice to Hosts.

Renters may cancel a booking up to 24 hours before the start time for a full refund. Cancellations made within 24 hours of the booking start time are eligible for a 50% refund at the Host’s discretion.

Hosts may cancel a confirmed booking in case of emergency, but repeated cancellations may result in penalties or removal from the platform. Renters will receive a full refund for any Host-initiated cancellation.

If a parking space is materially different from its listing description, Renters may request a full refund through our dispute resolution process.

You may not use ParkHawaii for any unlawful purpose or in violation of these Terms. Prohibited activities include but are not limited to: listing spaces you do not have authority to rent, using spaces for vehicle storage beyond the booking period, subletting booked spaces, or using spaces for commercial operations without Host consent.

Users may not attempt to circumvent ParkHawaii’s payment system by arranging off-platform transactions. Any fraudulent activity, including fake listings or reviews, will result in immediate account termination.

ParkHawaii operates solely as a technology platform connecting parking space owners with renters. We are not a parking operator, property manager, or insurance provider. We make no representations about the safety, security, condition, or suitability of any parking space listed on the platform.

All parking arrangements are made directly between the host and renter. ParkHawaii is not a party to any agreement between hosts and renters and expressly disclaims all liability for any damages, losses, theft, vandalism, personal injury, or any other harm — whether expected or unexpected, direct or indirect — arising from the use of any parking space listed on our platform.

Use of ParkHawaii is at your own risk.

ParkHawaii reserves the right to modify these Terms of Service at any time. We will notify users of material changes via email or through a prominent notice on our platform at least 30 days before changes take effect.

Your continued use of ParkHawaii after any changes constitutes acceptance of the updated terms. If you do not agree with the changes, you must stop using the platform and close your account.
